A lesson in civics

In a debate between Bill Ritter and Farmer Bob, the Congressman said "I'm going to appoint judges that apply the law, not interpret it." I learned in elementary school that the judicial branch interprets the law, the legislative branch makes the law, and the executive branch enforces the law. this might be a guess but maybe, just maybe, you learned an oversimplified version of the actual process of the application of the law. i believe his point, when not reduced down to elementary terms, is that judges are quite frequently becoming activists and essentially changing the law instead of applying it to the specific situation. i could provide you with several law journal articles on the issue.

also, how would a judge interpret the law without applying it? would he just sit around and think about what the law means? that's not what they do. they interpret the law in order to apply it to a specific situation.

here's another shocker: the executive branch also interprets the law instead of just enforcing it. they claim it's because they need to know what the law means before enforcing it! blasphemy! stick to enforcement only!
